General Terms and Conditions
- The following terms and conditions apply to our live auctions and, accordingly, to our online auctions.
- With the exception of our own goods, the auction is conducted on behalf of and for the account of our clients (consignors) in the order in which the items are listed in the catalogue. The auction items are identified by a number.
- The auctioneer reserves the right to withdraw numbers, separate them, auction them out of sequence or withdraw them, as well as to exclude certain persons from the auction and reject written bids.
- Viewing and inspection take place before the auction; the location and time are indicated in the catalogue. The auction goods are sold as viewed. The items are described in the catalogue to the best of our knowledge and belief. The catalogue description does not constitute a guaranteed characteristic in accordance with Sections 459 ff. of the German Civil Code (BGB). The auctioneer accepts no liability for errors in the goods. Unless expressly stated, the goods have not been tested for functionality. Transformers and switchgear do not comply with current VDE regulations. They are therefore offered for collection purposes only and with no liability. Lots are generally excluded from exchange. Despite the use of state-of-the-art technology, the illustrations in this catalogue may contain colour deviations from the original. Colour accuracy cannot be guaranteed.
- Written bids must be received at least three days before the auction. The auctioneer may reject unknown bidders unless security is provided. The minimum bid increment is 5 euros up to 100 euros, 10 euros up to 1,000 euros and 100 euros above 1,000 euros. The auctioneer may allow or set other bidding increments. The prices stated in the catalogue are minimum prices. (Lower bids cannot be considered). No liability can be accepted for input errors, as errors may occur in handwritten bids. This applies in particular to advance bids submitted at short notice.
- The bid is accepted if no higher bid is made after a bid has been called three times. Objections must be raised immediately; in this case, the bid will be called again. In the event of several bids of the same amount, the bid will be decided by lot. Upon acceptance of the bid, a purchase contract is concluded between the consignor, represented by the auctioneer, and the bidder to whom the bid has been accepted.
- The acceptance of the bid is binding. Upon acceptance of the bid, the risk relating to the auctioned item passes immediately to the purchaser; it is the responsibility of the purchaser to protect themselves against the risks of loss, theft, damage or destruction of the items in question by taking out insurance.
- Ownership remains with the consignor or seller until the purchase price has been paid in full. A claim for surrender shall only exist thereafter. Until payment and transfer of ownership, storage shall be at the expense and risk of the purchaser.
- Bidders present on the day of the auction must pay the auctioneer or an authorised representative the hammer price, premium and value added tax due on the day of the auction in cash or by Eurocheque card with PIN. Credit cards are not accepted. Absentee bidders will receive an invoice for the hammer price, premium and value added tax, which must be paid within the period specified therein. The items will be shipped after receipt of payment and at the expense of the purchaser. The costs for postage and packaging will be charged at cost. If the buyer wishes to take out additional insurance, this shall be at his own expense.
- A surcharge of 16% plus statutory VAT (total 19.04%) will be added to the hammer price. The VAT on the commission and ancillary costs will be invoiced separately. Invoices issued during the auction must be checked immediately due to high workload. Any costs incurred shall be borne by the bidder.
- Complaints regarding obvious defects must be received by the auctioneer as soon as possible after receipt, or at the latest within 10 weeks after the auction, for forwarding to the consignor.
- If the purchaser is in default of payment, he shall pay default interest of 1.5% (to the auction house) for each month or part thereof. The purchaser is free to prove that the damage did not occur or is less than the above lump sum. After setting a deadline with a rejection order, the purchaser loses all rights arising from the bid, the items will be sold at their expense, they are liable for the loss and have no claim to the additional proceeds. The auctioneer is entitled to claim damages for non-performance in the amount of 30% of the hammer price (due to lost consignor and buyer commission); the right to prove higher expenses remains reserved, and the buyer is free to prove that the expenses were lower.
- The auctioneer is entitled to collect or sue for the purchase price, purchase price arrears and/or ancillary services in a third party's name.
- Claims for damages against the auctioneer, whether arising from delay, impossibility of performance, positive breach of contract, culpa in contrahendo, tort or liability for damage caused by the auctioned goods, are excluded, unless the damage was caused intentionally or by gross negligence.
- The above terms and conditions also apply to the resale.
- Each visitor is liable for any damage caused by them. The auctioneer exercises domiciliary rights in all auction premises and reserves the right to exclude persons from viewing or bidding without giving reasons.
- The saleable and inheritable rights of use, exploitation and copyright to the illustrations in this catalogue are exclusively reserved to the auctioneer and the owner of the auction items at the time of publication of the catalogue. They are not transferred to the purchaser upon acquisition within the framework of the auction on which this catalogue is based. The right to these illustrations expressly includes reproduction and publication as well as the exercise of all ancillary and subsequent rights. The purchaser in the auction waives all rights to these illustrations.
- The submission of a verbal or written bid constitutes acceptance of these auction conditions.
- The place of performance for both parties is the registered office of the auction house (Ladenburg).
- Should any provision be invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
- In the event of discrepancies, the German auction text shall always apply. The images contained in this catalogue and on the website are our property. Reproduction and secondary use require our written consent.
- In the case of vehicles, the description is based on the consignor's report. These are classic cars for which no warranty of any kind is given.
- Storage costs for auctioned cars will be covered by the auction house for up to 2 weeks after the auction, after which the costs of storage will be borne by the buyer/consignor. Storage costs per day: £50
- Complaints about auctioned items will only be accepted within 10 weeks of the auction; later complaints cannot be accepted after the consignor has been paid.
